1. About these terms

Death Race Tracking ("DRT") is run by Ian Peppiatt, trading as Lethargic Imp ("we", "us"). We are registered with the Information Commissioner's Office, number ZC106342. You can reach us at [email protected].

These terms cover the website at deathracetracking.com and the Death Race Tracking apps for iOS and Android. By using DRT you agree to them. If you don't agree, please don't use DRT.

Our Privacy Policy explains what we do with your personal data. Our Cookie Policy explains the cookies we use.

2. Your account

You can browse races, films and release dates without an account. To track what you've watched, you sign in with Google or Discord.

• You must be 16 or over to have an account.
• You must be 18 or over to donate or subscribe, or have the permission of a parent or guardian who agrees to these terms for you.
• One account per person. Your account is yours alone and you are responsible for what happens on it.
• Keep your Google or Discord login secure. Tell us if you think someone else has used your account.

3. Using DRT fairly

DRT is for your own personal, non-commercial use. Sharing links to DRT, your profile, your ballot or your lists is welcome. Please don't:

• log films you haven't watched, run more than one account, or do anything else to distort the leaderboards or community ratings;
• harass, threaten or impersonate anyone;
• copy or collect data from DRT in bulk, by scraping or any other automated means. The list links and downloads we provide are fine to use as intended;
• collect other users' details, or use DRT to send spam;
• try to break, overload or get around the security of DRT, or access accounts or data that aren't yours;
• use DRT for anything unlawful.

4. What you add to DRT

Some of what you add can be seen by other people: your display name and avatar, your place on the leaderboards, your badges, a public profile or ballot if you choose to share one, and lists you share. Your film notes are private and only you can read them. Your ratings are combined with everyone else's into community averages that don't identify you.

You own what you add. You give us permission to store it, display it and process it as far as we need to run DRT's features. That permission is non-exclusive and free of charge, and it ends when you delete the content or your account. We don't sell what you add and we don't use it in advertising.

Anything other people can see must be yours to share and must not be abusive, hateful, sexually explicit, misleading or unlawful, or infringe anyone else's rights. We may remove or reset anything that breaks these rules.

If you send us an idea or suggestion, we may use it to improve DRT without owing you anything.

5. Donations and subscriptions

DRT is free to use. If you'd like to support it, there are two ways, both made from the upgrade page.

• Donation: a one-off payment of any amount from £1 to £1,000. It gives you Donator status for 12 months, then lapses. There is nothing to cancel and it never renews.
• Subscription: £12 a year. It gives you Subscriber status and renews automatically each year until you cancel. We email you a reminder before each renewal.

You can cancel a subscription at any time from the upgrade page. You keep Subscriber status until the end of the year you have already paid for and you won't be charged again. Cancelling doesn't delete anything you have tracked.

Payments are taken by Stripe. We never see or store your card details. Prices are set in pounds. If you pay in another currency, Stripe sets the exchange rate and may add a conversion fee.

If we change the subscription price, we will email you at least 30 days before your next renewal so you can cancel first.

The features that come with each status are listed on the upgrade page and in Help. We may add to or change them.

6. Refunds

Your supporter features switch on as soon as you pay. When you pay, you ask us to start straight away and you accept that you lose the 14-day right to cancel that would otherwise apply. Because of that, we don't refund donations or subscription payments, including renewals.

This doesn't affect your legal rights if something you paid for is faulty or not as described. If you think you were charged by mistake, email us and we will put it right.

7. Adverts

Free accounts may see adverts from Google AdSense. Adverts only load if you turn Marketing on in Cookie Settings. Donators and subscribers don't see adverts.

8. Film data and other sites

Film details, posters, release dates and where-to-watch information come from other services, including TMDB and JustWatch. DRT uses the TMDB API but is not endorsed or certified by TMDB. We add nominations and race information ourselves.

We work to keep all of this right, but it can be incomplete, out of date or wrong. Check with the cinema or streaming service before you travel or pay for anything.

DRT links to other websites. We don't control them and aren't responsible for what they contain or do.

DRT is an independent fan project. It is not affiliated with or endorsed by the Academy of Motion Picture Arts and Sciences, BAFTA, the Golden Globes, Film Independent, Letterboxd or any other awards body or film service. Their names and trade marks belong to them.

9. Picks and ballots

Picks and ballots are a game played for fun. There is nothing to stake and there are no prizes.

10. Our content

The DRT name, logo, design and software belong to us. You may use DRT as it is offered to you, but you may not copy, resell or republish it without our written permission.

11. Changes to DRT

DRT is an independent project and changes often. We may add, change or withdraw features, and DRT may sometimes be unavailable. We don't promise that it will always be available or free of errors. If we plan a change that takes away something significant, we will try to tell you first.

12. Closing your account

You can delete your account at any time from your profile. This permanently deletes your data, including your watch history, ratings, notes and friends, and cancels any subscription. Shared lists you created stay on DRT without your name. Deleting your account doesn't give you a refund. Our Privacy Policy explains what we keep afterwards and for how long.

We may suspend or close your account if you seriously or repeatedly break these terms. Where we can, we will tell you why.

13. Our responsibility to you

We provide DRT with reasonable care and skill, but we provide it as it is.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit. Nothing in these terms takes away your legal rights as a consumer.

Apart from that:

• we aren't liable for losses we couldn't reasonably have foreseen, or for business losses, because DRT is for personal use;
• we aren't liable for losses caused by events outside our reasonable control;
• our total liability to you is limited to £50, or the amount you paid us in the 12 months before the problem arose if that is more.

14. Changes to these terms

We may update these terms, for example when DRT's features or the law change. The date at the top of the page shows the latest version. If a change is significant, we will tell you by email or with a notice on DRT at least 14 days before it takes effect.

If you keep using DRT after a change takes effect, you accept the new terms. If you don't accept them, you can cancel your subscription and delete your account.

15. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales can deal with any dispute. If you live in Scotland, Northern Ireland or another country, you can also bring a claim in your local courts, and you keep any protections your local law gives you that can't be signed away.

If you have a complaint, please email us first. We will try to resolve it within 30 days.

16. General

• If a court finds part of these terms can't be enforced, the rest still applies.
• If we don't enforce a term straight away, we can still enforce it later.
• These terms are between you and us. Nobody else has rights under them.
• We may transfer DRT to another operator. If that happens, we will tell you, and your rights under these terms won't be reduced.
